Run-It Rental Service – Disclaimer
1. Brand Independence & Non-Affiliation
Run-It is an independent rental service and is not affiliated, associated, authorized, endorsed, or in any way officially connected with any of the shoe brands, manufacturers, or companies whose products are made available through our service. Any and all brand names, trademarks, logos, or proprietary product designs displayed or referenced in connection with our service are the registered or unregistered trademarks of their respective owners. The presence of any such branding on our website, in our marketing materials, or within our rental inventory does not imply any form of partnership, sponsorship, or approval by the respective brand owners. Run-It and Brecht Colemont do not claim any association with, nor do they distribute products on behalf of, any brand.
2. Nature & Condition of Rental Shoes
By engaging with the Run-It rental service, the renter acknowledges and understands that all footwear provided through our service is used and pre-worn, having been tested by previous renters before being reissued for subsequent rentals. While Run-It implements rigorous cleaning, sanitation, and maintenance protocols to ensure that shoes are returned in an acceptable condition, the renter explicitly accepts that rental shoes are not in brand-new condition and may exhibit signs of prior usage, including but not limited to:
- Minor outsole wear
- Creasing in the midsole and upper
- Light discoloration or scuff marks
- General aesthetic imperfections that do not affect performance
The renter waives any right to claim refunds, exchanges, or compensation based solely on the expectation of receiving an unworn or factory-condition product.
3. Limited Liability & Assumption of Risk
Run-It provides footwear on an “as-is” and “as-available” basis and makes no explicit or implied guarantees regarding the suitability, performance, durability, or fitness for a particular purpose of any rented shoe. The renter assumes all risks associated with the use of the rental shoes, including but not limited to personal injury, allergic reactions, improper fit, or discomfort. Run-It shall not be held liable, nor shall its owner/operator (Brecht Colemont, self-employed professional under Belgian law acting in a secondary occupation), for any damages, injuries, or performance issues arising from the use of rented footwear.
While rental shoes remain functional for training and competition purposes, renters should acknowledge that the performance of used footwear may degrade over time. Factors such as midsole compression, outsole wear, and minor material fatigue may contribute to a reduction in responsiveness, cushioning, and energy return compared to a brand-new pair of shoes. Although we ensure that all shoes provided remain in a high-performance state, they may not offer the same level of support, responsiveness, or durability as a new pair straight from the manufacturer.
4. Hygiene & Sanitation Disclaimer
While Run-It employs a thorough cleaning and disinfection process for all returned shoes, we cannot guarantee that shoes will be entirely free from all bacteria, allergens, or residual odors. Renters with specific hygiene concerns, skin sensitivities, or medical conditions affecting foot health should use the service at their own discretion and are advised to take additional precautions (e.g., wearing fresh socks, using personal insoles, or applying disinfectant sprays before use).
5. Responsibility for Personal Injury, Accidents & Performance Outcomes
The renter acknowledges that the effectiveness, comfort, or injury-prevention capabilities of a running shoe are highly subjective and vary based on individual biomechanics, training conditions, and external factors. Run-It and Brecht Colemont shall not be responsible for any claims arising from performance expectations. Renters are solely responsible for assessing whether a particular shoe model meets their personal training or race-day needs.
Run-It and Brecht Colemont shall not be held responsible for:
- Any injuries sustained while using rental shoes, including but not limited to blisters, muscle strain, stress fractures, or tendon injuries.
- Training setbacks, reduced performance, or adverse effects resulting from an improper shoe selection or fit.
- Any medical conditions aggravated by the use of rental footwear.
- Any expectation that rental footwear will provide identical performance to new footwear.
- Any legal claims against Run-It or Brecht Colemont regarding the perceived effectiveness or quality of the shoes.
- Any accidents, injuries, or incidents unrelated to the direct functionality of the shoe itself, including but not limited to traffic accidents, falls, collisions, or any external circumstances that may occur while wearing the rental shoes.
- Any property damage caused by the renter while wearing the shoes, including but not limited to broken equipment, damaged personal belongings, or harm to third-party property.
6. Fraud Prevention & Unauthorized Use
Run-It strictly prohibits the use of counterfeit, substituted, or non-original products in connection with our service. Renters must return the exact, original pair of shoes provided to them. Any attempt to swap, alter, or return a fake or different pair will result in penalties, legal action, and permanent exclusion from the service.
Furthermore, Run-It and Brecht Colemont shall not be held liable for any claims from third-party brands regarding the unauthorized use, resale, or distribution of their products. Renters acknowledge that all shoes remain the property of Run-It and are provided strictly for temporary use under a rental agreement.
7. Force Majeure & External Factors
Run-It and Brecht Colemont shall not be liable for any delays, disruptions, or service unavailability due to factors beyond our reasonable control, including but not limited to postal strikes, natural disasters, supply chain disruptions, or government-imposed restrictions. In such cases, Run-It reserves the right to modify rental timelines or refund orders as deemed appropriate under the circumstances.
8. Final Acknowledgment
By using the Run-It rental service, the renter expressly acknowledges and agrees to this disclaimer in its entirety and waives any claims against Run-It and Brecht Colemont (self-employed professional under Belgian law acting in a secondary occupation) related to product condition, brand affiliation, personal injury, performance expectations, accidents, or any legal disputes arising from the nature of the rental service.
The renter further agrees that any disputes related to Run-It shall be subject exclusively to the governing laws of Belgium, and any legal claims must be pursued in Belgian courts.
